Terms and Conditions of Première French Académie
Effective Date: Sep 2024
1. AGREEMENT TO TERMS
By enrolling in any course, accessing any service, or participating in any class offered by Première French Académie (“the Academy”), you (“the Client,” “you,” or “the Student”) — or your legal guardian in the case of minors — agree to be legally bound by these Terms and Conditions (“Terms”). These Terms constitute the full and binding agreement between you and the Academy, superseding all prior communications or understandings.
2. NON-REFUNDABLE PAYMENTS
All payments are final and non-refundable under all circumstances, including but not limited to illness, missed classes, scheduling conflicts, change of mind, or dissatisfaction with services. By enrolling, you accept that no refunds will be issued.
2.1 Course Credits
Credits may be granted solely at the Academy’s discretion, only if a class is canceled with a minimum of 24 hours’ advance notice. All issued credits are non-transferable, non-exchangeable, and expire within 3 months of issue.
3. SCHEDULING & CANCELLATION POLICY
The Student agrees to attend all sessions on time. If more than 20 minutes late without prior notice, the session is marked as forfeited with no eligibility for credit or rescheduling. By enrolling, the Student waives any right to dispute forfeited sessions.
The Academy reserves the right to reschedule or cancel any session for any reason with reasonable notice. In such cases, a make-up class, substitute tutor, or course credit will be offered — at the Academy’s discretion.
4. CONDUCT AND CLASSROOM POLICY
The Academy maintains a zero-tolerance policy for disrespectful, disruptive, or non-cooperative behavior. Students must:
-
Attend on time
-
Keep cameras and microphones functional and on (unless otherwise instructed)
-
Follow tutor guidance respectfully
-
Avoid distracting activities
Failure to comply may result in immediate removal or termination without refund. Determination of misconduct is made solely at the discretion of the Academy.
4.1 Parent Participation
Parents may observe lessons involving minors, but must remain off-camera and must not interfere with instruction.
5. PRIVACY & RECORDING POLICY
Recording, photographing, screen capturing, or distributing any session or material — in full or in part — is strictly prohibited without prior written consent from the Academy. Breach of this policy will result in immediate termination of service without refund and may result in legal action.
Students may request a recording only in advance, subject to tutor approval.
6. INTELLECTUAL PROPERTY
All class content, handouts, recordings, outlines, and digital materials are the exclusive intellectual property of the Academy. These materials are provided for personal educational use only and may not be copied, sold, published, or redistributed in any form.
Violation of this clause may result in legal liability under international copyright laws.
7. TECHNICAL ISSUES
The Student is fully responsible for securing a working internet connection, functioning device, and compatible software. If a session is disrupted due to a Student-side issue, the Academy is not obligated to offer a replacement session.
If a class is interrupted due to a tutor-side issue, a make-up class, recording, or $10 course credit may be offered — at the Academy’s sole discretion.
8. PROMOTIONS & DISCOUNT POLICY
Discounts or promo codes must be applied at checkout. They cannot be applied after payment or retroactively. Promotions are subject to change or withdrawal at any time and hold no cash value.
9. CERTIFICATES & STUDENT RECOGNITION
Certificates of completion are provided digitally after full completion of a course. A printed copy is available for a $25 processing and mailing fee.
Student awards (e.g., “Student of the Week”) are granted solely at the Academy’s discretion and are symbolic in nature, not monetary or contractual.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by law, the Academy shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from or relating to course participation, content, materials, communication, or use of services — regardless of cause.
The Academy does not guarantee any specific learning results or outcomes.
11. GOVERNING LAW & JURISDICTION
These Terms shall be governed and interpreted in accordance with the laws of the State of Nevada, USA. All legal disputes shall be resolved exclusively in the state or federal courts of Nevada. By enrolling, you waive any jurisdictional challenges and consent to personal jurisdiction in Nevada.
You also waive the right to participate in any class action or jury trial against the Academy.
12. CHANGES TO TERMS
These Terms may be amended at any time with prior written or electronic notice. Continued use of the Academy’s services after updates constitutes acceptance of the revised Terms.
13. ENTIRE AGREEMENT
These Terms constitute the entire agreement between the Student and Première French Académie, and override all previous versions or representations. No verbal or informal representations shall modify these Terms unless made in writing by the Academy.
14. FINAL CONSENT CLAUSE
By enrolling, you confirm that you have read, understood, and voluntarily agreed to all the terms above. You also acknowledge that you had the opportunity to consult with legal counsel prior to enrollment and waive any future claim based on misunderstanding or lack of information.
